Terms of Service

Freshclub provides warehousing, cold‑chain logistics, last‑mile distribution and fulfillment services as agreed in separate service schedules. All services are subject to accepted quote or contract.

Prices are as quoted. Invoices are payable within agreed terms. We reserve rights to suspend services for overdue accounts. Any GST or taxes will be shown separately.

Subject to Australian Consumer Law (ACL), Freshclub's liability for direct loss is limited to the value of the services paid for in the relevant month. We exclude indirect and consequential loss to the fullest extent permitted by law.

Privacy, data protection & retention

We handle personal information in accordance with the Privacy Act and the Australian Privacy Principles. Details of what we collect, how we use it, retention periods and rights to access or correct data are in our Privacy Policy.

Data for operational purposes (order fulfilment, traceability, recalls) may be retained for periods required by law or industry standards. For privacy complaints contact privacy@freshclub.website or the OAIC.

Dispute resolution & governing law

These terms are governed by the laws of the State of Victoria, Australia. If a dispute arises, parties will first attempt good faith negotiation and mediation. If unresolved, the parties may pursue court proceedings in Victoria.

Consumers in Australia retain rights under the Australian Consumer Law which cannot be excluded by contract.
